Terms of Service. The agreement for using Perpetual.
These terms are an agreement between you and Perpetual, Serbia (MB 68759196 · PIB 115933404). By creating an account or using the service you accept them. If you use Perpetual for a company, you accept them on its behalf and confirm you may do so.

01The service
Perpetual turns public business signals, such as hiring, into a list of companies that are likely to need what you sell, suggests one person to contact at each, drafts a message grounded in that evidence, and sends it from your mailbox only after you approve it.
Perpetual is in early access. Features change, some are experimental, and the service may be unavailable at times. We will tell you before we start charging for anything; paid plans will have their own pricing terms.
02Who may use it
Perpetual is for business use by people aged 18 or over. You must give accurate account information, keep your login secure and tell us promptly at [email protected] if you suspect someone else is using your account. You are responsible for activity in your workspace.
03Your responsibilities for outreach
You decide who is contacted and what is sent. You agree that you will:
- comply with the laws that apply to your outreach, including data protection law (the GDPR and the Serbian ZZPL), electronic marketing and communications law, and anti-spam laws such as CAN-SPAM;
- contact people only about offers that are relevant to their professional role;
- send under your real identity, with accurate sender details and subject lines;
- keep the opt-out link we add to every email and never try to remove or bypass it, or contact anyone who opted out;
- review each message before you approve it or, if you switch on automatic sending or automatic replies, review the rules, sequences and plays they use before you do;
- accept that you are responsible for every message sent from your workspace, including messages sent automatically within the rules you set.
04Acceptable use
You may not use Perpetual to:
- send bulk unsolicited email, phishing, malware, or deceptive, harassing, hateful or illegal content;
- contact consumers at personal addresses, or process special categories of personal data;
- resell, scrape or export our research data to build a competing database;
- probe, overload or break the security of the service, or access another customer’s data;
- get around sending limits, suppression lists, approval gates or other safety controls.
We may pause sending or suspend an account that breaks these rules or puts other customers’ deliverability at risk.
05Connected mailboxes
When you connect a mailbox, you authorise us to send from it the messages you approve or that your automatic-sending rules allow, and to read replies, bounces and opt-out requests that relate to them. You can disconnect at any time. Your email provider’s own terms and sending limits continue to apply.
06AI-generated content
Research summaries, rankings and drafts are produced with the help of AI and public data. They can be incomplete or wrong. Check them before you rely on them, send anything or switch on automatic sending; results such as replies or meetings are not guaranteed.
07Data protection
Our Privacy Policy explains how we process personal data. Where we process personal data on your behalf, we do so as your processor under a data processing agreement, which we provide on request at [email protected].
08Ownership
You keep the rights to the content you put into Perpetual, including your offer descriptions and the messages you approve, and you give us the permission we need to run the service with it. We own the service, its software and our research database. Feedback you give us may be used to improve the product without obligation.
09Ending the agreement
You can stop using Perpetual and ask us to close your account at any time. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering the service, with reasonable notice where possible. After closure we delete your workspace data as described in the Privacy Policy.
10Disclaimers and liability
During early access the service is provided “as is” and “as available”, without warranties of any kind to the extent the law allows. We are not liable for indirect or consequential losses, such as lost profits, lost business or damage to reputation. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or EUR 100 if you paid nothing. None of this limits liability that cannot be limited by law, such as for intent or gross negligence.
You will compensate us for claims by third parties that result from messages you sent or from your breach of these terms.
11Changes to these terms
We may update these terms as the product develops. For material changes we will give account holders notice by email or in the product before they take effect. Continuing to use Perpetual after that means you accept the new terms.
12Governing law
These terms are governed by the laws of the Republic of Serbia. Disputes go to the competent court in the Republic of Serbia, unless mandatory law gives you the right to go to court elsewhere.
